O'Reilly vs. Napolitano ("I don't care about the Constitution")

Bill O'Reilly: "I don't care about the Constitution." No surprise there.

David Kramer adds: "By the way, did you catch that “class” act O’Reilly referring to Napolitano as a “pinhead” at 1:56? Don’t you always get the feeling when you watch an O’Reilly tirade/interview that you are watching a schoolyard bully? (Okay. That’s not fair. If there are any schoolyard bullies reading this, I apologize.)"

  1. O'Reilly clearly comes out on top here. I love Judge Napolitano, but he's wrong here because KSM is not a U.S. citizen, clealy a terrorist, falls under the rules concerning military tribunals and should have already been executed. O'Reilly's point that this will be a propaganda display, facilitated by our Justice Dept is right on and show how amazingly stupid Holder's Justice Dept is. In the years when Jefferson prosecuted the war against the Tripoli pirates, KSM would have been executed at sea for his crimes under military tribunal. If there is any crime the Bush Administration was guilty of at Guantanimo, it was treating enemy combatants too civily, with kid gloves, I believe, in fear of world opinion.

  2. There was no declaration of war, Anonymous. That's why O'Reilly is wrong. The Constitution applies. He pretty much conceded that point.

    More importantly, I believe in natural rights not "constitutional rights." The right to a fair trial is a natural human right, not a privilege that only American citizens are given in the Constitution.

    Also, from a Christian point of view, I wouldn't say that avoiding torture and swift execution is a "crime."

    I'm not sure if you're a Christ-follower, but let me ask you: if you are a Christian, how have you personally wrestled with Jesus' requirement of his followers to love their enemies? What does it mean for a Christian to love KSM and others who hate you?
